General Terms and Conditions Of Use


These Sale General Conditions are concluded between, on the one hand, Bijo; with a capital of 7,500 € registered on Paris RCS with the number 484 920 426, and having its registered office at 10 rue Casimir Delavigne, 75006 Paris, and, on the other hand, any person having made a purchase on the site https: // bijo. paris /, and referred as "the Client". Any purchase on the site https://bijo.paris/ automatically entails acceptance of all of these conditions, that the customer acknowledges having read before placing his order.


Article 1: Buyer’s capacity

The Client who makes a purchase on the site declares that he / she has the legal capacity to accept these Terms and Conditions.

Article 2: Price

All prices presented on the website include all taxes. The products’ prices are in Euros, except for products sold towards the United-Kingdom which are in Pounds. Bijo; reserves the right to modify its prices without warning; the Client will pay the price he /she was quoted at the moment of purchase. The goods remain the property of Bijo; until the payment has been made in full by the Client.

Article 3: Presentation of Articles

Bijo; undertakes to present and describe the products sold on its website in the most accurate and precise manner as possible. 

Article 4: Orders

An online order is processed once payment has been accepted by Bijo;. Bijo; reserves the right to refuse orders placed by customers when previous problems involving payment have arisen. Bijo; also reserves the right to request any necessary information from the customer, such as proof of identity or proof of address. If the customer does not respond within 5 days, their order will be automatically cancelled. Bijo; only undertakes to process received orders if stocks allow it.

Article 5: Delivery to mainland France 

All orders placed before 12:00 pm are shipped the same day, all orders placed after 12:00 pm are shipped the next day, except for pre-orders, subject to stock availability and usual order flow. Orders placed on Friday afternoon, Saturday and Sunday will be shipped the following Monday. Orders placed on public holidays will be shipped the next business day.

The Customer has the choice between several delivery methods: via Colissimo in 48 working hours, via Chronopost in 24 working hours.

Upon receipt of the package, the Customer must check the condition of the package and unpack it in the presence of the delivery person.

In case of damage or breakage, the Customer must refuse the package and clearly note the reason for refusal on the delivery slip, mentioning the nature of the damage to the container and the contents. Example : Damaged parcel and broken product..


Article 6: Delivery outside mainland France 

All orders placed before 12:00 pm are shipped the same day, all orders placed after 12:00 pm are shipped the next day, except for pre-orders, subject to stock availability and usual order flow. Delivery outside of Metropolitan France is done by Colissimo or Chronopost. Any delivery in the DOM - TOM and abroad is systematically treated as "international delivery" according to the postal rates in force on the day of the order. Outside the European Union, customs or import taxes may be added to the price of our products and remain the responsibility of the Customer. It is therefore up to the Customer to find out the amount of these taxes from his local customs office. The shipping costs are at the charge of the Customer and vary according to the place of destination.

Article 7: Payment

A. Methods of purchase 

When the Client validates his/her purchase, he/she accepts The Terms and Conditions of Sale. The Client pays for their purchase on https://bijo.paris:

- by Bank card (Visa or Marstercard), through the secure payment platform; Stripe

- via Paypal or Apple Pay

- with a gift card.

B. 3D secure payment

Your order may be subject to a 3D Secure verification. 3D Secure is a system of payment by authentication to ensure optimal security during your online purchases. During payment, your bank verifies the identity of the cardholder before validating the transaction.
How does a 3D Secure verification work? After validating your bank details, you are transferred to your bank's website. In the 3D Secure window that appears, the authentication process to follow is specific to each bank. You may be asked to:

- To enter your date of birth
- To enter a code received by SMS
- To validate via the application of your bank 
- Or answer a personal question.

This exchange of information between you and your bank is secure. It guarantees the identity of the card user. For any question about the 3D Secure code (obtaining, loss, modification...), contact your bank directly. ATTENTION: After 3 failed authentication attempts, your transaction is cancelled. C. Verification of payment 

In order to protect against certain abusive fraud practices, Bijo; moderates the orders placed on the website. In order for this to be carried out effectively, our client service team may contact you to collect certain information to validate your order. They may ask proof of address in your name, or in the name of the person to whom the order will be delivered.

Article 8: Secure Payment - Protection of bank transfers 

Bijo; entrusts the security of transactions to the service provider Stripe. The payment is secured using the online payment system of our partner Stripe. The bank details only appear in our systems in encrypted form, this means that they are coded in such a way that they cannot be understood and are therefore never held by Bijo;.

Article 9: Data Protection 

The personal data communicated by the Client on the website https://bijo.paris are subjected to computer processing. It is processed in order to treat and deliver the orders and to suggest to the Client products adapted to his / her specific needs. The recipient of the data will only be Bijo;.

The Client may subscribe to the Bijo; newsletter and therefore chose to be regularly informed about the offers. The Client can unsubscribe at any time.

Article 10: Return & Exchange 

The Client shall have a period of 14 days to withdraw from his / her order, without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire physical possession of the products.

Pursuant to article L.121-28 of the French Consumer Code and article 16(e) of Directive 2011/83/EU of 25 October 2011, the Client cannot withdraw from contracts as regards the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g. care products, make-up products…). Any product returned to Bijo; in violation with article L.121-28 of the French Consumer Code and article 16(e) of Directive 2011/83/EU of 25 October 2011 will be sent again to the Client at Bijo’s expense without the Customer being entitled to any compensation.

To exercise the right of withdrawal, the Client must inform Bijo (10 Rue Casimir Delavigne, 75006 Paris, FRANCE – info@bijo.paris)  of his / her decision to withdraw from the contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form as set out hereafter:

In case of withdrawal from the Customer, Bijo; will reimburse the Customer for the amount of his order, including delivery costs (with the exception of additional costs arising from the fact that he has chosen, where applicable, a more expensive delivery method than the standard delivery method offered by Bijo ;) no later than fourteen days from the day Bijo; is informed of its decision to withdraw.

Bijo; may defer reimbursement until receipt of the returned products or until the Customer has provided proof of shipment of the products, the date selected being that of the first of this situation.

When the order was accompanied by a gift offered to the Customer under conditions - for example, a gift offered only if a minimum order amount was reached - and the Customer no longer fulfills the conditions necessary to obtain the gift due to the 'exercise of the right of withdrawal by the Customer, the gift must be returned to Bijo; with returned products and Bijo; may defer reimbursement until receipt of the gift or until the Customer has provided proof of shipment of the gift, the date chosen being that of the first of this situation.

 

Bijo; will refund using the same way of payment as the one used for the initial transaction, unless the Customer expressly agrees on a different means and this refund does not incur costs for the Customer.

The Customer must return or return the goods to Bijo;,  at the latest fourteen days after the Customer has communicated his decision to withdraw. This deadline is deemed to have been met if the Customer returns the goods before the expiration of the fourteen-day period.

The Client will have to bear the direct cost of returning the products.

Bijo ; advises the Customer to choose a shipping method with a tracking number. Without a tracking number, Bijo ; will not accept any claim.

The Client is only liable for any diminished value of the products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the products.

Article 11: Gift Cards 

The vouchers sent by Bijo; in exchange for a return or purchased by the Customer on the Eshop can be used for 1 year on all the products offered on the site https://bijo.paris/ . Eshop vouchers are not valid in stores. Vouchers cannot be combined with each other or with promotional codes and cannot give rise to a cash refund. Any voucher will be exchanged or refunded, even partially for any reason whatsoever (including theft, loss, deterioration or expiration).

Article 12: Promotional Codes 

Promotion codes only apply to non-discounted base prices. Promotional codes cannot be combined with each other or with vouchers. Promotional codes can be used once per Customer account unless otherwise instructed by Bijo;. These codes are not refundable during an exchange.

Article 13: Intellectual Property

All the elements present on the site https://bijo.paris/ , whether visual, textual or sound, are the exclusive property of Bijo ;, or of the holder of the intellectual property rights concerned, and are therefore protected. by the code of intellectual property and copyright. As such, any reproduction of the Bijo brand; or of the site https://bijo.paris, partial or complete, is strictly prohibited.

It is permitted for links to be made to our site, however this must be done in an honest manner and such a link cannot pose a threat to our good name or seek to profit from our reputation. It is strictly forbidden to put a link to our website on a site that is not your own. Article 14: Limitation of liability 

The Bijo; company cannot be held responsible with regard to third parties, in the event of indirect damage, special damage or incidents resulting from negligence, failure or clumsiness of the Customer, or resulting from improper use by the Customer of one of the products offered for sale on the site https://bijo.paris/ . Concerning access to the site, consultation of the latter, the ordering process, payment, delivery and service, the company Bijo; has only an obligation of means. Bijo's responsibility; cannot be held liable for any inconvenience or damage inherent to the Internet network, in particular any disruption of the connection or any intrusion of a computer virus. In addition Bijo; is exempt from any liability for any fact qualified as force majeure within the meaning of the jurisprudence of the Court of Cassation. Finally, Bijo's responsibility; is limited to the amount of the Customer's order.


Article 15: Legal Guarantee

Products sold on the website https://bijo.paris are subject to the legal guarantee relating to compliance and to the guarantee against latent defects as per articles 1641 and the subsequent articles of the civil Code.

15.1 Legal Guarantee of compliance

Article L. 217-4 of the French Consumer Code: The seller delivers a product that complies with the description given in the contract and is liable to the consumer for any lack of conformity in the goods at the time when they are delivered. The seller is also responsible for lack of conformity that result from packaging, and from set-up or installation instructions when such conformity was covered by the contract or was performed under its responsibility. Article L. 217-5 of the French Consumer Code: The good is compliant with the contract: 1° if it is appropriate for the use normally expected for such an article and, where applicable: - if it matches the description given by the seller and possesses the qualities shown to the purchaser in the form of a sample or model ; - if it has the qualities that a purchaser might legitimately expect in view of public statements made by the seller, the producer or his/her representative in advertising or labelling ; 2° Or if it has the features defined by mutual agreement between the parties or if it is suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to. Article L. 217-12 of the French Consumer Code: Any legal action prompted by lack of conformity is governed by a term of prescription of two years as of delivery of the goods.

15.2 Warranty on defective items

Article 1641 of the French Civil Code: The seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them. Article 1648 of the French Civil Code: The action resulting from latent defects must be brought to the attention of the seller by the purchaser within two years after the discovery of the defect.

When the Client brings an action based on the legal guarantee of conformity for goods, he / she:`

-       Has to bring the action within two years of delivery of the goods;

-       May chose between the repair or the replacement of the goods, subject to the cost conditions provided by article L.217-9 of the French Consumer Code;

-       Does not have to prove the existence of the lack of conformity of the goods if the defect appears within 2 years of the delivery of the goods.

The legal guarantee of conformity for goods applies irrespective of the commercial guarantee that the seller may have granted. 

The Client can bring an action based on the warranty against latent defects of the sing sold as provided by article 1641 of the French Civil Code and may chose in that case between (1) returning the thing and having the price returned to him or (2) keeping the thing and having a part of the price returned to him pursuant to article 1644 of the French Civil Code.

The Customer accepts and fully acknowledges that French law governs these General Conditions of Sale, as well as any dispute or litigation that may arise between the Customer and the company Bijo;. In addition, the Internet user (or the Customer) accepts that in the event of a dispute, following a
visit or a purchase on https://bijo.paris, it is the French courts which are recognized as having jurisdiction.
